A TWO DAY TRIBUNAL HEARING HAS NOW BEEN ALLOCATED TO DECIDE UDW GENERAL SECRETARY'S CLAIM FOR UNFAIR DISMISSAL!

Further to Jim Mc Ewan's pre-hearing review last Tuesday (12th July) we are pleased to update members & the wider public with the following information:

Jim's case was unallocated on Tuesday as there were no judges available to hear the claim. The parties were sent away & a case management order was subsequently issued on the 20th of July 2011.

We are very pleased to report that the case management order has revoked the pre-hearing review, and allocated a 2 day tribunal hearing to decide Jim's claim for unfair dismissal on its merits. Further directions regarding the Employment Tribunal Rules of Procedure 2004 and exchange of supporting evidence & witness statements have also been issued.

We would remind members and the public that Jim Mc Ewan (a founding & leading UDW organiser who has represented thousands of workers including John Ledbury & Alan Roberts) was sacked in a letter from John Ledbury with the alleged support of Alan Roberts & Dave Rawlinson in May 2010, after Jim challenged Ledbury over unexplained missing union funds, extorting money from vulnerable workers in the street, abuses of office and misleading the UDW Trade Unions executive & members for his own personal gain.

The UDW have refused to answer a single one of the very serious public allegations put to them on countless occasions, choosing instead to hide behind pathetic and cowardly allegations of abuse against Jim (however they did enjoy Jim's challenges when he was fighting their corners as they were being attacked by management of course.)

Jim refuses to recognise Ledbury's position and continues to publicly challenge and expose corrupt, malicious and deceitful practices within UDW for the benefit of any trade union member and vulnerable workers who might stumble across this dodgy outfit.

We will of course provide you with the precise dates for the tribunal when we have them and will in the meantime continue to update this website for your information & knowledge.

 

UDW TRADE UNION'S GENERAL SECRETARY JIM MCEWAN'S CLAIM FOR UNFAIR DISMISSAL BEGINS ON TUESDAY 12th JULY 2011!

UDW General Secretary Jim Mc Ewan's claim for unfair dismissal,denial of statutory rights, unpaid wages and damages has been listed for a pre-hearing review to determine the issues, on Tuesday the 12th of July 2011 at 10:00 am at the East London Employment Tribunal Office, 2nd floor Anchorage House, 2 Clove Crescent, E14.

The claim is as a result of Jim being fired by letter after challenging the unions treasurer John Ledbury over abuses of office, fraud, deception and missing union funds. Ledbury claims he is supported in this action by Alan 'I know nothing' Roberts & David Rawlinson. John Ledbury has always claimed that Jim Mc Ewan (a founding member of UDW Trade Union) was never an employee & therefore had no rights that would protect him from being unfairly dismissed.

Can anyone begin to imagine that a so called workers 'Trade Union' would ever make such a pathetic and vile statement?

UDW TRADE UNION TAKEN TO EMPLOYMENT TRIBUNAL FOR UNFAIR DISMISSAL!

After sacking an official and founding member of the UDW Trade Union, its Executive members Alan Roberts, John Ledbury and Dave Rawlinson have had a claim filed against them for unfair dismissal, unpaid and lost earnings and denial of statutory rights as defined in the Employment Rights Act.

What makes this all the more amazing is that the official actually represented two of these people at discipline and grievance hearings in their present and previous employment!

The official who had worked solely for the UDW Trade Union since its beginning and had also personally recruited and serviced hundreds of its members, discovered by chance that significant amounts on money had gone missing from the union’s central account. He also found that the UDW’s treasurer John Ledbury had entered his daughter Claire Jackson onto the union’s chequebook account as a co-signatory, without anyone’s knowledge or permission.

The official had been forced to borrow money to repair a union car, and it was at this time that he discovered that the union’s account had no funds available for the repair.

On finding out that workers were also being forced to pay money in the street to Ledbury for their representation, the official wrote a five page open letter to John Ledbury, Alan Roberts & Dave Rawlinson complaining of abuse of office and misappropriation of union funds to which he received no reply.

The official was sacked a few weeks later in a letter from John Ledbury claiming the support of Roberts & Rawlinson with further statement that he was not an employee, and therefore had no rights of appeal.

In the year preceding these events that same official had actually attended a grievance hearing on behalf of Alan Roberts who was experiencing harassment from a Regional DHL Manager. Roberts himself is a DHL Manager and requested the help of the official who represented him and put a stop to the behaviour Roberts had complained about. Yet when the official filed his concerns with Roberts as a member of the UDW’s Executive, Roberts did a ‘Manuel from Fawlty Towers’ impression claiming, “I know nothing.”

Indeed this is the stance they have all used since the employment tribunal claim was entered against them. Requests for information and disclosure have all gone unanswered with Ledbury even recently attempting to deceive the Tribunal Office.

John Ledbury also used the same official to represent him at two discipline hearings in his previous employment as a driver in DHL, and as a handyman at a nursing home in Wincanton, before he took on a full time position within UDW Trade Union in the summer of 2009. Ledbury then went on to sack that very same official a few months later, while procuring his salary and benefits for himself.

In summary when the official blew the whistle on abuse of office and missing monies, these so called champions of workers rights ignored his serious concerns and fired him.

This claim against UDW Trade Union will shortly be listed for a hearing pending further directions from an Employment Judge. We will of course be pleased to keep existing members and the general public well informed.

Take a moment and think about it though: A Trade Union that claims to represent workers and enforce their rights, themselves carried out an unlawful sacking, deduction of outstanding wages and denied statutory rights. They claim to ensure that your employer treats you fairly and with respect at all times. That this is why you should consider becoming a member. Yet that same so called trade union knifes one of their own long standing officials in the back when he flags up abuse and potential theft and fraud within its ranks?

Are these really the kind of people you would want representing you in your workplace? How can they effectively challenge your employer and support a member when they ignore and fire an employee who brings abuses to their attention? This is surely an act of hypocrisy of the worst kind from so called workers representatives. Anyone coming across this outfit should swiftly decide “Now that’s what I call a dodgy trade union!”
